Gribben v the United Kingdom (dec.) (App no 2884/18)

The challenge

An application was made to the European Court of Human Rights (ECtHR) in relation to the applicant’s brother who was killed in October 1990 by the British Army.

The NIHRC was granted leave to intervene by way of written submissions.

The NIHRC’s submissions were focused on Article 2 European Convention on Human Rights (ECHR) and the particular context of the inquest system in Northern Ireland.

Human rights engaged

The applicant argued that the inadequacies in the investigation amounted to a breach of Article 2 ECHR. The investigation has previously been the subject of two previous applications to the ECtHR.

Outcome

The European Court of Human Rights (ECtHR) found the application inadmissible.
