The challenge

The Industrial Tribunal requested the NIHRC to intervene in an application before it, where it was required to consider granting an anonymity order in respect of a past judgment of the Tribunal.

NIHRC provided written submissions based on the human rights framework only and did not engage in the specific facts of the case.

Human rights engaged

The NIHRC’s submissions were focused on Articles 8 and 10 ECHR and how the Tribunal could exercise its role in balancing the competing rights engaged.
