Briefing Note for Ad Hoc Committee on a Bill of Rights EU Withdrawal and a Bill of Rights

This short paper for the Ad Hoc Committee on a Bill of Rights gives an overview of the ‘no diminution’ commitment in Article 2 of Protocol on Ireland/Northern Ireland (‘the Protocol’) and then provides an analysis of the potential considerations for a Bill of Rights against the backdrop of the new commitment and the curtailed application of the Charter of Fundamental Rights of the EU (‘the Charter’). It concludes by highlighting opportunities to ensure complementarity of approach regarding the Bill of Rights, Human Rights Act 1998 and the Article 2 no diminution commitment.
