Consent to examination and treatment

This response primarily addresses whether or not the guidance documents produced by the Department address adequately the relevant human rights issues. The Human Rights Commission considers that, as a public authority, the DHSSPS has a responsibility under the Human Rights Act 1998 to consider the provisions of the European Convention on Human Rights in determining appropriate practice and procedure for the obtaining of consent to examination and treatment.
