NICS on Magistrate Courts sex offender orders amendment rules

The Commission has no objection to the principles behind the Rules, although we would have
appreciated consultation at an earlier stage. The Orders allow the imposition of
prohibitions and notification requirements, and serious criminal sanctions may follow any
breach. It is important that any Order, and especially any Interim Order made before a
court has been able to establish that the two conditions necessary for a full Order exist,
should be made in strict accordance with the law, not least to avoid a challenge based on
relevant European Convention rights.
