Education has long been recognised as a fundamental human right. Numerous

international human rights documents refer to the right to education, including the

United Nations Universal Declaration of Human Rights, the United Nations

Convention on the Rights of the Child, and the European Convention on Human

Rights (now incorporated in domestic law through the Human Rights Act 1998).

These documents guarantee every child the right of access to education, free from

any form of discrimination. The Commission uses these and other international

human rights standards as a basis for examining any legislative or policy

proposal.
