Social Security Fraud bill
The Commission regrets that, due to extreme pressure on its resources, it has been unable to
provide a full and timely analysis of the compatibility of the Social Security Fraud Bill with
the Convention rights entrenched in the Human Rights Act 1998 (“the HRA”), and with
other human rights standards. The following comments are provided to Assembly members
at this late stage in the Bill’s progress to help inform the debate on the Bill itself, and the
Code of Practice that is to follow.1 The Commission may wish to make separate
representations when that Code is issued for consultation, but it is likely that the issues
raised by the Code will be substantially the same as those discussed below.
